A source told TMZ: “If Liam wanted to put up a fight, he could in California because there’s a new law that allows judges to determine which party is best suited to keep the pets.

“The judge puts a lot of weight on who cares for the animals. Judges even have the power to award joint custody of household pets.

The news comes just days after the Hunger Games actor filed for divorce from the singer and actress, citing irreconcilable differences.

According to PEOPLE the celebrity couple, who have each made their own mini fortune, signed a prenuptial agreement before their marriage – so a messy divorce seems unlikely.

Upon hearing her now ex-husband had filed for divorce, a Miley source told PEOPLE that the singer, “didn’t expect it”.

“She didn’t expect it and is a bit disappointed, but she is still doing well and has obviously moved on as well,” the source said.

“What she and Liam had for a long time was very special.”

“It’s just hard for her to think that she will never have this again with Liam,” the source continued.

“There are really so many things that she loves about him.”

Miley, 26, and Liam, 29, met on the set of The Last Song when both were still teenagers, and had an on-again-off-again romance for ten years before getting married in a private ceremony on December 23, last year at the family home in Tennessee.

Miley has since been linked to Brody Jenner’s ex-wife, Kaitlynn Carter.
